CASE ADOPTION CRITERIA


EAJ adopts administrative and legal cases and establishes funding to those adopted.
Case adoption is considered after review of the following minimum criteria:

    (1) Applicant's location (from the home office) - the closer the better.

    (2) Agency's location (from the home office) - the closer the better.

    (3) Applicant's need (financial) - to what degree the applicant can fund their case. An applicant must be in need to receive our assistance; funding or otherwise.

    (4) Applicant's liability - to what extent the applicant is liable, in the event the case is lost. The less liability and the more immune the applicant is from any liability, if any, the better.

    (5) Extent of the impact.

    (6) Urgency of the impact.

    (7) Number of people that would be affected - the more the better.

    (8) Importance - the relative significance of the case.

    (9) Available funding from (other sources) - whether funding or assistance is available from other sources and to what extent; proportionally.

    (10) Qualified applicant - whether the applicant has standing, or can acquire standing, and whether the applicant is committed to seeing the case through to the end.

    (11) Make a difference - will assistance and/or funding make a difference?

    (12) Conflict of interest - whether adoption will lead to a conflict of interest.

    (13) Timeliness - whether there is enough lead time for us to respond sufficiently, in a timely manner.

    (14) Consistency - whether the case is, and to what extent it is, consistent with our purpose(s).

    (15) Applicant's character - whether the applicant's character will become an issue and, if it will, whether the applicant's character is unassailable.
